VOLUNTARY WAIVER; RELEASE OF LIABILITY; INDEMNIFICATION AND HOLD HARMLESS AGREEMENT WHEREAS a Airsoft tournament/Operations and/or Airsoft Training Video has been organized and players desire to participate in such, the following must be read and agreed to prior to participating in the EWAirsoft event: WAIVER. Every player including their parent/guardian, if the player is under 18 years of age (collectively and jointly, if applicable, referred to hereafter as Player), must read this Waiver Form. Signatures below signify each Player has read, understands and abides by this information. Every Player, in behalf of himself/herself, his /her personal representative, heirs and next of kin, acknowledges and agrees that there are risks connected with Player’s participation in this Airsoft tournament and its related activities (hereafter referred to as the Event). Player hereby releases, waives, discharges and covenants not to sue David Walters, and or, Angie Walters, including but not limited to the Event workers, employees, volunteers, independent contractors, security officers, officials, referees, directors, the owner of the Event premises, licensees (including, but not limited to, television licensees), charities, agents, officers, attorneys, insurers, servants, parents, divisions, municipalities, subsidiaries, predecessors, successors and representatives (collectively referred to herein as "Event Organizers") from all action, suits, and demands whatsoever in law or in equity from demand, losses or damages, actual and consequential, past, present and future, arising out of or in any way related to the Event, including but not limited to intentional torts an any claims of personal injury or death from playing in the Event, any prizes awarded, and any loss of collegiate or high school eligibility as a result of participation in the Event, whether caused by the negligence of the Event Organizers or otherwise. Player hereby acknowledges, agrees and represents that he/she will inspect the facilities and equipment to be used in the Event. In the event Player believes that any unsafe conditions exist, Player will immediately cease from participating in the Event and advise the Event Organizers. INDEMNIFICATION AND HOLD HARMLESS: Every Player hereby agrees to indemnify and save and hold harmless the Event Organizers and each of them from loss, liability, damage, or costs they may incur due to Player=s participation in the Event, whether caused by the negligence of the Event Organizers or otherwise. ASSUMPTION OF RISK: Every Player, hereby assumes full responsibility for and risk of bodily injury or property damage due to the negligence of the Event Organizers or otherwise while participating in or observing the Event. GOVERNING LAW: This Voluntary Waiver, Release of Liability, Indemnification and Hold Harmless Agreement shall be governed by the laws of the State of Washington with jurisdiction and venue exclusively vested in Spokane County, Washington. ACKNOWLEDGMENT: Every Player acknowledges that he/she has read the above, understands its terms and is executing this Agreement voluntarily. DATED this, ____ day of _____________, 2011
